Kvitka CRM Terms of Service

Welcome to Kvitka CRM!

These Terms of Service (hereinafter referred to as the "Terms") govern the use of the Kvitka CRM cloud CRM/ERP system (hereinafter referred to as the "Service"). By registering for or using the Service, you confirm that you have read and agree to comply with these Terms.


1. About the Company

Kvitka CRM is a cloud CRM/ERP system for business process automation, including sales, purchasing, inventory, manufacturing, finance, customer relationship management, and other processes.

2. Registration and Account

To use the Service, you must create an account.

The User agrees to:

  • provide accurate information during registration;
  • maintain the accuracy of their data;
  • ensure the confidentiality of their login and password;
  • not share account access with third parties without proper authorization.

All actions performed through the user account are deemed to have been performed by the user themselves.

3. Trial Period

New users may be provided with a free trial period of up to 30 calendar days.

The trial period allows users to explore the functionality of Kvitka CRM and evaluate if it fits their business needs before purchasing a paid subscription.

Upon completion of the trial period, a paid subscription plan must be selected to continue using the Service.

4. Pricing Plans

Access to Kvitka CRM after the trial period is provided based on the selected subscription plan.

The current list of plans, features, and pricing is published on the "Pricing" page.

Payment is processed using the available payment methods offered during checkout.

5. Refund Policy

A free 30-day trial period is provided to allow users to fully test Kvitka CRM's features before committing to a paid subscription.

For this reason, once a paid plan is activated, fees are generally non-refundable, as the user had sufficient time to evaluate the Service.

However, the company may issue refunds in the following exceptional cases:

  • duplicate or accidental payments;
  • payment gateway processing errors;
  • confirmed technical issues with the Service that made its use impossible;
  • other exceptional circumstances at the company's sole discretion.

6. User Data

All data created or uploaded by the user in Kvitka CRM remains the exclusive property of the user.

The Company will not use this data for its own commercial purposes, except as required by Ukrainian law or stipulated in the Privacy Policy.

The User is solely responsible for the accuracy and legality of the data they input.

7. Service Availability

We aim to ensure the continuous operation of Kvitka CRM.

However, temporary interruptions may occur due to:

  • scheduled maintenance;
  • software updates;
  • performance optimization work;
  • emergency situations;
  • circumstances beyond the company's reasonable control.

The Company will make all reasonable efforts to restore the service as quickly as possible.

8. Prohibited Use

The User is prohibited from:

  • using the Service in violation of any applicable laws;
  • attempting to gain unauthorized access to the Service;
  • interfering with the operation of the software;
  • using malware or viruses;
  • generating excessive load on the servers;
  • copying, modifying, or distributing Kvitka CRM software without prior written consent from the rights holder.

9. Intellectual Property

All rights to the Kvitka CRM software, source code, design, logos, documentation, and other materials are owned by GEOMETER INTERNATIONAL LLC.

Purchasing a subscription plan does not transfer any intellectual property rights to the user.

The User receives only a non-exclusive right to use the Service for the duration of their paid subscription.

10. Limitation of Liability

The Service is provided on an "as is" and "as available" basis.

The Company does not warrant uninterrupted operation of the Service or the complete absence of technical errors.

The User is solely responsible for:

  • the accuracy of input data;
  • maintaining regular backups of critical information;
  • business and management decisions made based on information obtained from the Service.

The maximum liability of the company for any claims shall not exceed the actual amount paid by the user for the last billing period of the Service.

11. Termination

The User may stop using Kvitka CRM at any time.

The Company reserves the right to suspend or terminate access to the Service in the event of:

  • violation of these Terms;
  • use of the Service for illegal purposes;
  • security threats to the Service or other users;
  • failure to fulfill financial obligations.

12. Changes to Terms

The Company may update these Terms from time to time.

The new version is published on the official website of Kvitka CRM and becomes effective upon publication, unless stated otherwise.

Continued use of the Service after changes are published constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine.

All disputes arising between the user and the company shall be resolved through negotiation, or, if no agreement is reached, in the courts of Ukraine.
